1. Who these Terms cover
These Terms of Service govern access to and use of kaijustamps, a wallet-based digital stamp card platform for merchants and their staff. In these Terms, "kaijustamps," "we," "us," and "our" mean There There, Sole proprietorship in Japan, operating the kaijustamps service.
A merchant or staff user who creates an account, joins a merchant organization, configures a stamp card program, issues cards, adds stamps, redeems rewards, or manages billing is a "Merchant User." A person who receives or uses a wallet stamp card from a merchant is a "Cardholder."
2. The Service
kaijustamps lets merchants configure a digital stamp card program, issue wallet cards through short-lived in-shop QR codes, add stamps by scanning a card QR code, and redeem earned rewards in person. Cardholders can receive and use wallet cards without creating a kaijustamps account.
We may improve, change, suspend, or discontinue parts of the Service. We will try to avoid unnecessary disruption, but we do not guarantee that every feature will always be available or error-free.
3. Merchant responsibilities
Merchants are responsible for the accuracy and legality of their card names, shop names, reward descriptions, terms and conditions, staff activity, and any promises made to Cardholders. Merchants must honor the rewards they publish unless their own customer-facing terms clearly and lawfully say otherwise.
Merchants must use kaijustamps only for lawful loyalty, reward, and shop card operations. Merchants must not use the Service to mislead Cardholders, scan cards without a legitimate shop purpose, attempt to bypass usage limits, interfere with security, or collect sensitive personal information through card text or reward terms.
4. Accounts and access
Merchant Users must provide accurate account information and keep sign-in methods secure. Activity performed through a merchant organization may be treated as authorized by that organization unless we have been notified of compromise and had reasonable time to act.
Merchants are responsible for inviting the correct staff members, assigning appropriate roles, and removing access when staff no longer need it.
5. Cardholders and wallet providers
Cardholders do not need a kaijustamps account to receive or use a card. A Cardholder's wallet card, card QR, and card-linked page are intended only for that Cardholder's use with the issuing merchant.
Apple Wallet, Google Wallet, device manufacturers, browsers, and other third-party services are not controlled by kaijustamps. Their own terms, availability, review processes, and technical limits may affect wallet card delivery or display.
6. Billing
Paid merchant subscriptions are billed per merchant organization. Unless a separate written agreement says otherwise, the Shop Card plan is $8 per month, includes 500 issued cards per month, and adds $0.015 for each issued card above the included monthly amount. A first subscription receives 50% off the monthly fee for the first two months: $4 per month. Standard rates apply afterward. New subscriptions do not include a free trial.
Billing, payment method management, invoices, and cancellation flows may be provided through Polar as merchant of record or payment infrastructure. Merchants are responsible for all fees, taxes, and usage charges incurred by their organization.
7. Data and privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, Merchant Users agree that kaijustamps may process account, organization, billing, card operation, and support information as described in that policy.
Merchants must provide any customer-facing privacy notices required for their own shop operations and must not use kaijustamps as a workaround for unlawful tracking, profiling, or marketing practices.
8. Ownership
kaijustamps and its software, designs, logos, and platform materials are owned by kaijustamps or its licensors. Merchants retain responsibility for their own shop names, logos, card copy, reward copy, and other content they submit.
Merchants grant kaijustamps the limited right to host, process, display, and transmit merchant content as needed to provide and support the Service.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not promise that the Service will be uninterrupted, secure, or free from errors, or that wallet provider systems will always accept, display, or update every pass.
kaijustamps is not responsible for merchant reward economics, in-shop disputes between a merchant and a Cardholder, or loss caused by a merchant's incorrect program settings or staff actions.
10. Limitation of liability
To the maximum extent permitted by law, kaijustamps will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of goodwill, data, business opportunity, or revenue, even if we were advised that such damages were possible.
To the maximum extent permitted by law, the total aggregate liability of kaijustamps for all claims relating to the Service will not exceed the amount actually paid or payable by the affected merchant organization to kaijustamps for the billing period in which the event giving rise to the claim occurred. If no amount was paid or payable for that billing period, the liability cap is zero dollars.
The limitations in this section apply to every theory of liability, including contract, tort, negligence, strict liability, warranty, statute, and any other legal theory, to the maximum extent permitted by law.
11. Suspension and termination
We may suspend or terminate access if we reasonably believe a Merchant User or organization has violated these Terms, created security risk, caused payment failure, or used the Service in a way that could harm kaijustamps, merchants, Cardholders, or third-party providers.
Merchants may stop using the Service at any time. Cancellation of a paid subscription should be completed through the billing flow made available in the Service or by contacting kaijustamps if that flow is unavailable.
12. Changes and contact
We may update these Terms from time to time. The updated version will be posted on this page with a revised last updated date. Continued use of the Service after an update means the updated Terms apply.
